CONSENT TO PARTICIPATION AND ASSIGNMENT OF IMAGE RIGHTS FOR STUDY IN RELATION TO MASTITIS

Introduction

LactApp is carrying out a project related to the detection and evolution of mastitis, with the aim of improving the care that women receive in relation to it. 

To carry it out:

– We collect data on symptoms.

– We collect images of breasts affected by mastitis and, equally, breasts that do not suffer from it. In particular, usually three photographs per person will be required (front, side and from below the breast).

If you would like to help us by participating in the study, we need you to read this text in which we offer you all the information and accept it if you agree.

Parts

I, from now on “the participant”, confirm that I am of legal age and that I have the image rights of the photographs, from now on “photographs” or “images”, that I will give to LactApp Women Health, SL with NIF number: B66777780 and domiciled in Barcelona, Calle Valencia, 263, 3º 1ª, from now on LactApp. Below are the conditions of the contract:

Purpose of the transfer of data on symptoms and images

The symptomatology, data and images provided by the participant will be used solely and exclusively for study and research purposes related to breastfeeding and all possible pathologies and health problems possibly associated with it.

LactApp agrees not to publish or disclose the photographs under any circumstances.

The study and research tasks will be carried out by LactApp together with third parties, with whom LactApp will share the symptomatology, data, images and associated information in an anonymous way. 

LactApp is committed to establish a data use contract that ensures the correct use of the data and its non-distribution outside the agents involved in the research.

Who can be a participant in this study

We are looking for women over 18 years old who may have symptoms related to mastitis, both because they coincide with some symptoms and because they are properly diagnosed by a doctor.

Likewise, we need women over 18 who do not have any pathology at this time.

Geographic scope and timing

The authorization does not have a determined geographical scope so LactApp may use the symptoms, data and photographs, or parts of them, in all countries of the world without geographical limitation of any kind. 

All this with the only exception and limitation of those uses or applications that could attempt the right to honor in the terms provided in the Organic Law 1/85 of May 5th, of Civil Protection to the Right to Honor, Personal and Family Privacy and to the Own Image. 

This authorization does not set any time limit for its granting or for the exploitation of the mentioned symptoms, data and photographs, or part of them, in which I appear as a model, so my authorization is considered granted for an unlimited period of time.

Acceptance

By accepting this notice, I expressly authorize LactApp to process these data, symptoms and images, in accordance with the purposes set out above.

At the moment of sending, I accept that I give my express consent in a free and unequivocal way.

Jurisdiction

The Parties, for the interpretation and execution of the present Consent of participation and cession of the right of image, with resignation to their own jurisdiction if they had it, are expressly submitted to the Courts and Tribunals of the city of Barcelona, Spain.
